1.1 For all services provided by Kaleido within the scope of its internet service at www.kaleido.ai, other associated websites and URLs, within the scope of mobile apps or integrations in third-party provider platforms (e. g. Facebook) for its customers (collectively referred to hereinafter as "service"), the following terms and conditions of use shall apply exclusively in the currently valid version. Deviations from this shall only apply if this has been agreed in writing between Kaleido and the user of the service (hereinafter referred to as the user).
2.1 Kaleido provides its users with a system that enables them to apply image effects to their images. The user can either upload the images from his or her local device or give Kaleido access to other storage locations (e. g. internet addresses or third-party platforms).
2.2 The scope of Kaleido's services is determined by the respective functions released within the framework of the website, the app or third-party integration.
3.1 The user has no claim to the processing of data provided by him/her. Kaleido reserves the right not to process data without giving reasons and without notification. The user is liable for the fact that the pictures and other data provided by him do not interfere with the rights of a third party in competition, trademark, personality, copyright or other rights and that the user has the authority to use the content within the framework of Kaleido. The user is responsible for all content that he/she supplies to the Kaleido system as well as for sharing or publishing result images.
3.2 The user agrees not to use any contents within the framework of Kaleido which

3.4 The user grants Kaleido a right to use the content posted by the user to the extent that Kaleido may publish the images in its own print and online media as well as the cooperation partners of Kaleido on their websites.
3.5 The user shall bear all reasonable costs incurred by Kaleido in connection with the user's content, including the costs of legal defence, arising from an infringement of third party rights. This does not affect all further rights and claims for damages of Kaleido against the user.
3.6 Kaleido does not assume any liability for contents which a user processes, uses or passes on within the scope of the service.
3.7 Users and affected parties who feel that their rights have been infringed by content can report these potential infringements to Kaleido at the e-mail address [email protected]
4.1 Kaleido shall not be liable for the availability of the Kaleido service or for its own actions and those of vicarious agents (with the exception of personal injury) unless they have been caused by gross negligence or willful intent. Kaleido is also not liable for data loss. Compensation for damages of any kind arising from third party claims is excluded. The contents provided are neither checked nor controlled.
4.2 Kaleido shall not be liable for the storage, transmission or correct presentation of the contents provided by the users. Furthermore, Kaleido does not assume any liability for topicality, correctness or quality of the presented contents.
4.3 Kaleido shall not be liable for any loss of data or damage to the respective device or data.
5.1 Austrian law shall apply. The UN Convention on Contracts for the International Sale of Goods is excluded. In case of disputes, the competent court for the Inner City of Vienna is to be called upon.
6.1 The app only uses the functions (APIs) provided by the operating system of the mobile device in the manner prescribed by the operating system. Third-party integrations use third-party APIs.
6.2 The app requires access to the Internet in order to retrieve data directly and make it available to the user. The processing and preparation of the data is carried out by Kaleido's infrastructure.
We store and process data exclusively in accordance with the Austrian Data Protection Act 2000. The user agrees to the processing of his data in the following scope.
We process and store image files that are uploaded, selected or otherwise made available by the by using the app. Image files are usually deleted immediately, but after 14 days at the latest.
We do not give image data to third parties, but provide user-controlled features for sharing (e.g. in social media).
Results and intermediate results from the processing of images (e.g. coordinates of recognized objects, image sections required for processing) are stored without any time limit. This data is stored without any reconstructable information about the origin of the file or the user's identity and is used exclusively to optimize the response time for repeated requests ("caching") and quality of service.
Some features may require users to log in via third-party platforms (e. g. Facebook, Twitter). After the user has given his/her permission, we receive the following information: The user ID of the platform, the first and last name as well as the profile picture of the user. We use this information to personalize the user interface. The data is only stored on the user's device. By using third-party features, third party providers may place cookies. The use is subject to the respective third party terms and conditions.
Our site and mobile apps use Google Analytics, a web analytics service, and Google Fabric, a mobile analytics service provided by Google, Inc. ("Google"). Google Analytics uses "cookies", which are text files placed on your computer to help the website analyse how visitors use the site. The information generated by the cookie about your use of the website, and the information generated by your use of the app, (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the website and mobile app, compiling reports on website/app activity for website/app operators and providing other services relating to website/app activity and internet/mobile usage.
Our site may contain links to enable you to visit other websites of interest easily. However, once you have used these links to leave our site, you should note that we do not have any control over that other website. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this privacy statement. You should exercise caution and look at the privacy statement applicable to the website in question.
The data provided by the user is used by us
We do not store or process any other user-related data.
We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law. We may use your personal information to send you promotional information about third parties which we think you may find interesting if you tell us that you wish this to happen.
We are committed to ensuring that your information is secure. In order to prevent unauthorized access or disclosure we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.
All data processed by us is encrypted and transmitted on its way from the client to the server.
